I want to respond to last night –

I was elected to the 2024 Board, with my term originally set to run through 2025. When a newly elected Board member resigned within two months of taking office, I was appointed to fill that vacancy, which carries a term through 2026. The same process was followed for Randy Riley, who moved from a one-year term to a two-year term. This was done to maintain the three annual vacancies required for election each year in accordance with our Bylaws. There is nothing in the Bylaws that prohibits this action, and this interpretation was confirmed by two past Board members as well as a resident familiar with our corporate practices and also our attorney. At present, I am serving in an interim capacity. Jenny intends to take the position once she is able to do so, as she has other responsibilities that require her attention.

Everyone has  concerns regarding legal expenditure. Yes, legal costs have been significant. Those expenditures have been incurred to uphold and enforce the Bylaws and rules. As Mark stated, the Bylaws and rules can be amended if the membership chooses to propose and approve changes through a vote. Likewise, if the membership is dissatisfied with my service, you have the ability to vote me out.

The corporation conducts background checks and properly vets’ prospective residents. These processes have protected the community from individuals with serious criminal histories, including a convicted drug dealer and  a conviction of financial crimes against the elderly. If the community wishes to change its standards regarding vetting or enforcement,  including pet policies,  that can be addressed through proper amendment procedures.

It is also important to note that maintenance fees have not increased over the past three years, despite these legal expenses. That is a direct result of careful financial stewardship by the Board. Let’s not forget to thank Tom Henning has dedicated the past six months to addressing the weep holes, saving the community thousands of dollars in potential repair costs.

I serve as a Board member on a volunteer basis because I care about this community, as I believe all current Board members do. If members are unhappy, you absolutely have the right to express that through the election process. Just understand that serving on the Board requires significant time and effort. Jenny is currently managing sales responsibilities and addressing ongoing legal matters from her previous role as Rules Director. She will transition into the Secretary position as her workload allows.
